This Vendor Agreement (“Agreement”) is made and entered into by and between Ewayja, an online marketplace that provides a platform for Jamaican businesses and individuals to buy and sell products and services, and the vendor (“Vendor”) who wishes to sell products and services on the Ewayja platform.
- Registration: To use the Ewayja platform as a Vendor, the Vendor must register and create an account. The Vendor must provide accurate and complete information, including a valid email address and phone number.
- Product and Service Listings: The Vendor agrees to provide accurate and truthful descriptions of the products and services offered on the Ewayja platform, including pricing, availability, and shipping options. The Vendor shall ensure that all products and services offered are of satisfactory quality and comply with all applicable laws and regulations.
- Prohibited Items: The Vendor may not sell any illegal or prohibited items on the Ewayja platform, including but not limited to stolen or counterfeit goods, drugs, weapons, and adult content.
- Liability: The Vendor is solely responsible for the products and services they offer, including any warranties, returns, or refunds. The Vendor shall indemnify and hold Ewayja harmless against any and all claims, damages, costs, expenses, and liabilities arising from the Vendor’s use of the Ewayja platform, including any breach of this Agreement. The Vendor agrees to transfer liability for any damages or losses that occur during shipping to the shipping company.
- Fees: Ewayja charges a commission fee for each sale made on the Ewayja platform. The commission fee is based on the total price of the product or service sold. The Vendor is responsible for paying all fees associated with using the Ewayja platform. Ewayja reserves the right to change its commission rates at any time upon reasonable notice to the Vendor.
- Intellectual Property: The Vendor represents and warrants that it has the right to sell all products and services offered on the Ewayja platform and that such products and services do not infringe upon any intellectual property rights of third parties.
- Termination: Ewayja reserves the right to terminate any Vendor account that violates our terms and conditions. We may also remove any product or service listing that violates our policies.
- Privacy: Ewayja collects and uses personal information in accordance with our privacy policy. By using our platform, the Vendor agrees to our privacy policy.
- Governing Law: This Agreement shall be governed by and construed in accordance with the laws of Jamaica.
By using the Ewayja platform, the vendor agrees to these terms and conditions. If the vendor does not agree to these terms and conditions, please do not use the Ewayja platform.
